LSSWMD meets to consider settlement

Members of the Lawrence Scioto Solid Waste Management District met Tuesday morning for a non-advertised meeting at the office of the County Commissioners. The purpose of the meeting was for the board to consider a settlement offer proposed by the Ironton-Lawrence County Community Action Organization.

Shortly after the Tuesday meeting was convened, the the LSSWMD board — without calling the meeting to order — voted to go into executive session with LSSWMD Director Dan Palmer included in the session. After a period in executive session the board reconvened into regular session.

A motion was then made to adjourn the meeting with little discussion, just that they were going to consider the proposal.

Nearly a month ago the LSSWMD, filed for a declaratory judgment in a matter against the Ironton-Lawrence County CAO. The case has been assigned to a common please court judge.

According to released information from the Lawrence County Common Pleas Court, the case has been assigned to Judge William Cooper.

The 17-page complaint names Ironton and Lawrence County Area Community Action, Dale Burchman, Board of Directors Chairman and D.R. Gossett, Executive Director of the Ironton and Lawrence County Area Community Action Organization as defendants. It asks for declaratory judgment on accounting, injunctive relief and damages and was filed in Lawrence County Common Please Court, March 8.

In 2012 LSSWMD cut ties with the Ironton-Lawrence County Community Action Organization. While in transition, a dispute arose between the agencies regarding the ownership of vehicles and about $150,000 in funds.

Unable to come to a resolution, LSSWMD is now seeking a declaratory judgment.

The LSSWMD Board of Directors consists of Scioto County Commissioners, Mike Crabtree, Doug Coleman and Skip Riffe and Lawrence County Commissioners Bill Pratt, Les Boggs and Freddie Hayes.
