Greenup Legion Post 43 pleads guilty to charges

According to a spokeswoman for the Greenup County Clerk of Court’s office, Dennis Page, Commander of the American Legion Post 43, located in Raceland, appeared in court Wednesday and entered guilty pleas to two charges.


“He pled guilty to one count of illegal sale of alcohol, and that was a $200 fine,” The spokeswoman told the Daily Times. “And he pled to one count of gambling without a license. There was a $200 fine on each count. They were to destroy all the alcohol, and monies totaling $3,600 have to be forfeited.”


Early media reports that half of the confiscated money would come to ABC in Portsmouth, turned out to be incorrect.


“According to the court order, half of that money will be coming to the Kentucky Department of ABC,” Nathan Jones of the Kentucky Public Protection Cabinet’s Department of Alcoholic Beverage Control (ABC), said. “The other half will go to the Raceland High School Football Booster’s Club.”


Jones said Greenup County was represented by attorney Michael Wilson, and Page, on behalf of Post 43, was not represented by an attorney.


According to Jones, the ABC and the Department of Charitable Gaming joined forces in a two-month investigation that stemmed from complaints alleging illegal activities at Post 43. The enforcement agencies executed a search warrant last week and discovered large quantities of alcoholic beverages, cash and gambling paraphernalia such as pull tabs. Undercover surveillance also revealed that alcohol was served and sold, and gambling was allowed on the property. When asked for a comment on the outcome of the court case Wednesday, Jones said his department does not deal with legal proceedings.


Adding to the problem is the fact that Greenup County is a dry county, which means liquor sales are prohibited.
